Congress gave the green light for consumer choice through Health Savings Accounts (HSAs) last year. Now, after several sets of guidance, Treasury resolved to open issues with more than 88 questions and answers of additional interpretive guidance, issued July 23, 2004. Buckle up as we provide an implementation roadmap to help chart the best course and avoid legal potholes down the road. Topics addressed include: HSA basics (who is eligible, what is a HDHP, impact on FSA and HRA plans); an implementation roadmap; and how HSAs operate in a cafeteria plan environment. Featured Presenters: 
John R. Hickman  is a partner with Alston & Bird, LLP, where he has been a member of the ERISA and Employee Benefits Practice Group since 1989. He received his law degree from Emory University School of Law, graduating with distinction, where he received the Order of the Coif award. Mr. Hickman's practice focuses primarily upon health and welfare benefit plan matters and the tax, ERISA and other compliance issues that arise in connection with such arrangements. Mr. Hickman has lectured widely and published articles on HIPAA, ERISA litigation, cafeteria and health plan issues. He is co-author of the Cafeteria Plans Manual and HIPAA Compliance for Group Health Plans (published by the Employee Benefits Institute of America). Mr. Hickman is also an adjunct professor of law at Emory University, is an executive member of the Employers Council on Flexible Compensation (ECFC) Technical Advisory Council and the Publications Committee of the Self Insurance Institute of America. He is a featured presenter in IAML's Certificate in Employee Benefits Law Seminar and Advanced Certificate in Employee Benefits Law Seminar.

Ashley Gillihan is also a member of Alston & Bird's Employee Benefits and Executive Compensation Group. Mr. Gillihan's practice focuses on health and welfare benefit plan matters where he advises clients on various issues including, but not limited to, tax qualification issues arising under the Internal Revenue Code, ERISA reporting, disclosure COBRA and fiduciary issues and HIPAA portability and privacy. Mr. Gillihan lectures frequently and has published many articles on health and welfare benefit plan compliance topics and is a presenter in IAML's Certificate in Employee Benefits Law Seminar.
