The Part 541 regulations have not been revised comprehensively in over 50 years. The new regulations now make significant changes which, in some cases, create new overtime pay obligations and, in others, clarify the job duty requirements for the so-called "white collar" exemptions from overtime pay.

The Labor Department has announced that it will "aggressively enforce" compliance with the new Part 541 Regulations. Employee groups and trial lawyers also threaten legal actions based on the changes your company or organization makes, or does not make, in exempt-nonexempt employee classifications, job duties, pay practices (including deductions from pay), and compensation policies initiated under the new regulations. As a result, all employers need to review their existing pay practices to ensure compliance with the new regulations, and especially to institute the regulations new "safe harbor" policy which will serve as a defense against legal liability.
