Each year, the U.S. Supreme Court issues several important decisions that direct affect human resource and other business professionals in their daily job duties. This teleconference discussed the key rulings in the employment arena and focus on the practical impact on employers and analyzed the National Labor Relations Board's recent holding that non-union employees are no longer entitled to request that a co-worker be present during investigatory reviews.

In just the last few months, the Justices of the U.S. Supreme Court have issued several key employment-related decisions. Specifically, the Court has tackled important issues such as:

  • Whether the ADA requires an employer to rehire a rehabilitated drug user;
  • Whether a group of workers can assert that the ADEA was violated when older workers were favored by the employer;
  • Whether employers may assert the "affirmative defense" to claims that a worker was forced to quit based on illegal harassment; and

The National Labor Relations Board's recent controversial decision (released June 15) rescinding non-union employees' right to have a co-worker present at an investigatory interview was also discussed. The decision overturns the Epilepsy Foundation ruling issued by the Board in 2000, which granted so-called Weingarten rights to non-union as well as union employees.
