For the first time since 1993-94, the Democrats control congress and the White House. Proposed legislation that has been stalled for years is now likely to become law, and become law soon. Congress has already passed, and President Bush has signed into law, the ADA Amendments Act (ADAAA) which is intended to expand the coverage of the Americans with Disabilities Act. Proposed legislation pending Congress includes the:

  • Employee Free Choice Act (EFCA) -- which would allow union certification via authorization cards without a secret ballot election;
  • Lily Ledbetter Fair Pay Act -- would specify that time limits for filing pay discrimination claims begin to run each time an employee receives a paycheck that manifests discrimination;
  • Employment Non-Discrimination Act -- would add sexual preference and sexual orientation as a protected class under Title VII;
  • Comparable Work Fair Pay Act -- would, among other things, require employers to compensate equally jobs that are dissimilar, if those dissimilar jobs are "equivalent, when viewed as a composite of skills, effort, responsibility, and working conditions";
  • FMLA -- an update.

For the ADAAA and the pending legislation, we will discuss what the legislation does (or will do), the effect it will have on the American workplace, and what steps employers should consider taking in order to prepare.

At the end of the conference, participants will understand what changes are likely in the offing and what the options and alternatives are for achieving compliance and preserving management's ability to run its operations as efficiently and effectively as possible.

John F. Wymer, III is a partner with the law firm of Paul, Hastings, Janofsky & Walker LLP in their Atlanta office, specializing in labor and employment law on behalf of management. He received his B.A. from the University of Alabama in 1971 and J.D. from the University of Virginia in 1974. He is a contributing Editor for The Developing Labor Law and a member of the Committee on the Development of Law Under the National Labor Relations Act. In 2008, Atlanta Magazine named Mr. Wymer one of the "Top Ten Lawyers in Georgia," and HR Executive Magazine identified him as one of the "Top 50" labor and employment lawyers in the United States. Since 1995, Mr. Wymer has been listed in Best Lawyers in America in the areas of Labor and Employment Law. In 2001, Mr. Wymer was elected as a Fellow by the College of Labor and Employment Lawyers. He presents IAML public seminars (which he has done for over 20 years!) as well as in-house training programs. He is also featured in IAML's DVDs. Mr. Wymer has exceptional teaching skills, a witty and engaging delivery style and the legal skills and knowledge to make his presentations valuable and entertaining, too.

Robert P. Kristoff is a partner in the employment practice of Paul Hastings' San Francisco office, where he practices labor and employment law, focusing on class action and other litigation, including wage hour, discrimination, harassment, and wrongful termination issues and union-management issues before the NLRB. He is a member of the Labor and Employment Law Committee of the San Francisco Bar Association; the State Bar of California Labor and Employment Law Section; and the American Bar Association Labor and Employment Law Section, Committee on Practice and Procedure Under the National Labor Relations Act. He has been chosen by his peers for inclusion in The Best Lawyers in America. Mr. Kristoff has lectured extensively before legal, academic and business groups on labor and employment law issues. He is the author of numerous articles and papers, including a Japanese language summary of American discrimination and sexual harassment laws. He is a graduate of Harvard College and Boston College School of Law.
