Recent changes to the Family Medical Leave Act (FMLA) have expanded coverage for new classes of workers and, in some instances, their relatives. In addition to those recent changes, proposed regulations that may be passed before the end of 2008 will substantially impact key FMLA definitions, the procedures for administering FMLA leave, the notice requirements, and the employer's right to medical information. The recent FMLA changes and proposed regulations also create new issues for employers under the Uniformed Services Employment and Reemployment Rights Act.

Historically, it is nearly unanimous from employers that the Family Medical Leave Act created more problems, issues and potential liabilities than any other federal law governing employment and the workplace. Court decisions and the out-of-date Department of Labor regulatory environment haven't helped.

This presentation will address the impact these recent FMLA changes and proposed regulations have on issues like:

  • Who is and is not covered under FMLA
  • Notice and certification requirements
  • Timeframes for different leaves
  • Benefits and pension plan administration
  • Interrelationship between FMLA and state leave laws

Featured Presenter:
James Carter is an Associate in the Employment Law Department with Paul Hastings in its Orange County, California office, where he concentrates his practice in the defense and counseling of employers on all aspects of employment law, including employment discrimination, harassment and wrongful termination litigation, wage and hour claims, breach of contract claims, and workers’ compensation issues. Mr. Carter brings to this practice prior litigation experience as a workers’ compensation applicant’s attorney, and experience as coverage and litigation counsel for the insurance industry. He has handled appeals before the 9th Circuit Court of Appeals and the California Court of Appeal, some of which resulted in published opinions. Mr. Carter received his B.A. degree in English from Brigham Young University and his J.D. degree from BYU’s J. Reuben Clark School of Law, where he served in the Moot Court organization, and competed on the school’s National Moot Court team. Mr. Carter is an instructor in IAML's Certificate in Employee Relations Law Seminar.
