For various legitimate business reasons, many employers have recently undertaken increasing and often creative efforts to regulate issues related to their employees' health. These efforts sometimes confront legal obstacles, although often state and federal law lends little guidance.

This discussion will focus on four specific employee health issues and the legal implications of employer regulation in these areas:

    1. Smoking
    2. Obesity
    3. Alcoholism
    4. Domestic Violence

For each area, we will discuss:

  • The business impact for employers arising out of these issues, including statistics about costs, lost productivity, and morale;
  • Standard and more creative methods employers have tried to confront these business issues; and
  • The legal pitfalls of regulation in each of these areas, including federal discrimination laws, more specific state laws, workers' compensation and other insurance implications, and relevant lawsuits.

After the training, you will be able to assess:

  • The extent to which the disability discrimination laws affect your ability to regulate issues related to your employees health;
  • The breadth of privacy protection in various states related to employee wellness;
  • The potential for specific regulation of employee off-duty conduct;
  • Unique issues in medical leave laws related to employee wellness initiatives;
  • Ideas to creatively address the business impact of your employees' health.

Featured Presenter:
Shay Ellen Zeemer practices in the area of Labor and Employment Law for Powell Goldstein LLP in Atlanta. Her practice includes representing management in employment discrimination lawsuits in various state, federal and administrative jurisdictions, including race, sex, disability, family and medical leave, and other discrimination claims. Ms. Zeemer's litigation experience also includes contract and fraud disputes arising from employment and independent contractor relationships. In addition to litigation matters, Ms. Zeemer's practice encompasses a wide array of counseling in employment and related issues, including review of employee handbooks and employment practices and policies. She has assisted clients involved in employment audits, including glass-ceiling audits. She has provided clients with guidance in employment disputes and investigations and drafted and reviewed enforceable employment contracts, restrictive covenants, and separation agreements.
